Assumption of Risk

I understand that participating in an outdoor vendor event involves certain risks, including but not limited to changing weather conditions, rain, wind, cold temperatures, uneven or slippery ground, outdoor equipment, tents, canopies, electrical cords, foot traffic, and other conditions associated with an outdoor event.

I voluntarily assume the risks associated with my participation and agree to take reasonable precautions to protect myself, my employees, my property, my merchandise, and my equipment.

Release of Liability

To the extent permitted by applicable law, I release and hold harmless the event organizer, event sponsors, property owner, venue, and their respective officers, employees, volunteers, and agents from claims for injury, loss, or damage arising from my participation in the event, except to the extent caused by their negligence, gross negligence, willful misconduct, or other conduct for which liability cannot legally be waived.

This release does not eliminate any rights or responsibilities that cannot legally be waived.

Vendor Property and Merchandise

I understand that I am responsible for my own merchandise, cash, equipment, displays, tents, tables, and personal belongings. I understand that the event organizer does not provide insurance for my property unless expressly agreed to in writing.

I agree to secure my merchandise, tent, canopy, signage, and equipment properly and to take reasonable steps to prevent damage, injury, or loss.

Weather and Outdoor Conditions

I understand that outdoor conditions may change during the event. I agree to secure my booth and equipment against wind and other weather conditions.

The event organizer may delay, relocate, suspend, or cancel the event because of severe weather, unsafe conditions, or other circumstances affecting safety. Any refund of vendor fees will be handled according to the event's separate vendor fee and cancellation policy.

Vendor Responsibilities

I agree to:

Follow all event rules, venue policies, and applicable laws.

Maintain a safe and orderly vendor space.

Properly secure tents, canopies, weights, displays, and other equipment.

Obtain any licenses, permits, and insurance required for my business or products.

Be responsible for the actions of my employees and representatives.

Leave my assigned space clean and free of trash or debris.

Immediately report hazards, injuries, or property damage to the event organizer.

Indemnification

To the extent permitted by applicable law, I agree to be responsible for claims, damages, or expenses arising from my own negligent or wrongful acts, violations of law, or breach of this agreement, including those of my employees or representatives acting on my behalf. This provision does not require me to indemnify any party for that party's own negligence or other conduct where such indemnification is prohibited by law.

Acknowledgment and Signature

I confirm that I have read and understood this Liability Waiver and Release of Liability. I understand that I am voluntarily participating in the event and have had the opportunity to ask questions before signing electronically.
